THE trial of soca star Machel Montano did not begin yesterday as scheduled because the entertainer had to perform at an event in Miami, Florida.
Montano's attorney Dana Seetahal SC informed Magistrate Maureen Baboolal-Gafoor that she (Seetahal) had previously indicated to the court that Montano would not have been available.
Seetahal added that in a letter dated March 5, she wrote a letter to the court stating that Montano was unable to attend yesterday's court hearing and that both the prosecution and defence had agreed to adjourn the matter to facilitate Montano.
Baboolal-Gafoor told Seetahal that she received the letter and did not respond to it because she "formed the opinion that the court was being told that Montano would not have able to attend and that both sides agreed to an adjournment".
Baboolal-Gafoor said that she found Montano's action "totally inappropriate".
"Mr Montano is on bail and as such he need to make himself available to come to court," she said. Baboolal-Gafoor said that she has, in the past, issued warrants for persons arrest who have to undergo surgery.
Montano, who returned to Trinidad yesterday after performing at the "Best of the Best" concert, held at Bicentennial Park, Miami, Florida is accused of using obscene language outside the Zen nightclub at Keate Street, Port of Spain.
Montano is also charged along with Joel "Zan" Fezeck, Kernel Roberts and Rodney "Benjai" Le Blanc for assaulting Brandis Browne and Russell Pollonais on April 26, 2007.
The matter would begin on Thursday and continue on June 2 and 5.
